Welcome to A Plus Literacy. These Terms of Use ("Terms") govern your access to and use of the A Plus Literacy website (the "Site") and the tutoring and literacy services we offer (the "Services"). By accessing the Site or enrolling in our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.
1. About Our Services
A Plus Literacy provides literacy tutoring and academic support services designed to help students strengthen reading, writing, vocabulary, and related literacy skills. Services may be delivered virtually or at an approved public location, such as the Buckeye Public Library. We do not provide in-home tutoring services.
Enrollment, scheduling, and program details are described on the Site and confirmed through a separate Tutoring Service Agreement.
2. Eligibility
Our Services are intended for parents, legal guardians, or individuals with legal authority to enroll a student in tutoring services. By enrolling, you represent that you have the authority to make educational decisions on behalf of the student.
3. Enrollment and Scheduling
Enrollment is completed through our intake process and finalized upon execution of a Tutoring Service Agreement.
Session availability is offered on a first-come, first-served basis and may be limited. Program structure, session frequency, session length, and scheduling details will be confirmed directly with families and may be adjusted with reasonable notice.
A Plus Literacy reserves the right to assign sessions to qualified staff members or contracted tutors. Where a contracted tutor is assigned, families will be notified, and the same quality standards and policies described in these Terms and the Tutoring Service Agreement will apply.
4. Payments and Fees
Program fees are billed as described at the time of enrollment and in the Tutoring Service Agreement.
Sibling discounts, referral credits, promotional offers, and other pricing incentives are subject to change at any time unless otherwise specified in writing.
Payments are processed through our designated payment providers.
Fees are non-refundable except as expressly stated in the Tutoring Service Agreement.
A Plus Literacy does not currently accept Arizona Empowerment Scholarship Account (ESA) funds as a form of payment.
If a family withdraws from the program, written notice is required as described in the Tutoring Service Agreement. Fees already billed for the current billing period are non-refundable, and the student's spot may be released for enrollment by another family once notice is received.
5. Attendance and Cancellations
Attendance requirements, cancellation procedures, rescheduling options, and make-up session policies are outlined in the Tutoring Service Agreement.
A Plus Literacy reserves the right to adjust scheduling due to illness, emergencies, severe weather, or other unforeseen circumstances. Reasonable efforts will be made to provide advance notice whenever possible.
6. Student Supervision
Parents or guardians remain responsible for the supervision, transportation, and safety of students before and after tutoring sessions.
For sessions held in public locations, students must be dropped off and picked up promptly according to agreed-upon schedules.
7. Technology Requirements
Families participating in virtual tutoring are responsible for providing reliable internet access, a compatible device, and an appropriate learning environment.
A Plus Literacy is not responsible for service interruptions caused by internet outages, technology failures, platform disruptions, or circumstances beyond our control.
8. Use of the Website
You agree to use the Site only for lawful purposes.
You may not:
Interfere with the security or operation of the Site
Attempt unauthorized access to the Site or related systems
Submit false or misleading information
Copy, distribute, or reproduce Site content without permission
Use the Site in any manner that violates applicable laws
9. Intellectual Property
All content on the Site, including text, graphics, logos, curriculum materials, lesson resources, designs, and branding, including the A Plus Literacy name, logo, and associated taglines, is the property of A Plus Literacy and is protected by applicable intellectual property laws.
Materials provided through our Services are for personal educational use only and may not be copied, reproduced, distributed, sold, shared publicly, or used for commercial purposes without prior written consent.
10. Educational Services Disclaimer
A Plus Literacy provides educational tutoring services only.
We are not a school, special education provider, psychologist, therapist, speech-language pathologist, medical provider, or diagnostic service.
Our Services are not intended to diagnose learning disabilities, medical conditions, or educational needs. Families seeking formal evaluation or diagnosis should consult a qualified school professional or licensed specialist.
11. No Guarantee of Results
While we are committed to providing high-quality literacy instruction and individualized support, A Plus Literacy does not guarantee specific academic outcomes, grade improvements, assessment scores, admissions decisions, or educational results.
Student progress depends on numerous factors beyond our control, including attendance, effort, practice, prior knowledge, and support outside tutoring sessions.
12. Limitation of Liability
To the fullest extent permitted by law, A Plus Literacy and its owners, employees, contractors, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the Site or Services, including but not limited to issues arising from student supervision, transportation, technology failures, or service interruptions described in Sections 6 and 7.
Our total liability for any claim relating to the Site or Services shall not exceed the amount paid by the client for the Services giving rise to the claim.
13. Privacy
Our collection, use, and protection of personal information are governed by our Privacy Policy.
By using the Site or Services, you consent to the practices described in our Privacy Policy.
While we take reasonable measures to protect personal and student information, no method of electronic transmission or storage can be guaranteed to be completely secure.
14. Communications
By enrolling in Services or submitting information through our Site, you consent to receive communications from A Plus Literacy regarding scheduling, enrollment, program updates, billing, and related service matters through email, phone calls, text messages, or other contact methods you provide.
You may opt out of non-essential communications, such as promotional or marketing messages, at any time by contacting us using the information in Section 20. Essential service communications, such as scheduling changes or billing notices, may still be sent as needed to administer your enrollment.
15. Third-Party Services
The Site and enrollment process may utilize third-party services, including scheduling platforms, online forms, communication tools, payment processors, and educational technology providers.
Your use of those services may also be subject to the third party's own terms, conditions, and privacy policies.
16. Termination
A Plus Literacy reserves the right to suspend or terminate Services for:
Non-payment
Repeated attendance issues
Violation of these Terms
Violation of the Tutoring Service Agreement
Inappropriate, disruptive, threatening, or unsafe conduct
Any circumstance that significantly interferes with the educational environment
Reasonable notice will be provided whenever practical, except in cases involving safety concerns or serious misconduct, where Services may be suspended or terminated immediately without prior notice.
17. Force Majeure
A Plus Literacy shall not be responsible for delays, interruptions, or inability to provide Services resulting from events beyond our reasonable control, including severe weather, natural disasters, power outages, internet disruptions, public health emergencies, government actions, or other unforeseen circumstances.
18. Changes to These Terms
We may revise these Terms from time to time.
Updated versions will be posted on this page with a revised effective date. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms.
19. Governing Law
These Terms shall be governed by and interpreted under the laws of the State of Arizona, without regard to conflict of law principles.
