A Plus Literacy LLC

Welcome to A Plus Literacy LLC ("A Plus Literacy," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, programs, and tutoring services. By enrolling in our services, submitting an intake form, signing a Tutoring Agreement, or using our website, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our services.
1. Services Provided
A Plus Literacy LLC provides literacy tutoring and academic support services, including reading, writing, and related skill instruction. Services are delivered virtually or at agreed-upon locations such as the Buckeye Public Library, according to the plan selected at enrollment.
Current tutoring plans, pricing, and session availability are listed on our Pricing page and confirmed during enrollment.
2. Eligibility and Enrollment
Our services are intended for students under the supervision of a parent or legal guardian. By enrolling a student, the enrolling parent or guardian represents that they have the legal authority to do so and to consent to the Tutoring Agreement.
Enrollment is completed through our intake form and Tutoring Agreement, and is subject to availability.
3. Payments and Billing
Monthly plan fees are billed according to the plan selected at enrollment.
Payments are accepted via Zelle and Stripe. Payments made via Zelle are considered final and non-disputable once sent, as Zelle does not provide buyer protection or chargebacks.
Payment is due as outlined in the Tutoring Agreement. Late or missed payments may result in suspension of services until payment is received.
A Plus Literacy LLC does not currently accept Arizona Empowerment Scholarship Account (ESA) funds.
All fees are non-refundable except as expressly stated in the Tutoring Agreement or required by law.
4. Scheduling, Cancellations, and Rescheduling
Sessions are scheduled in advance based on plan type and availability.
Families are responsible for notifying A Plus Literacy LLC as early as possible if a session needs to be rescheduled or canceled.
Repeated late cancellations, no-shows, or scheduling conflicts may affect continued enrollment, as outlined in the Tutoring Agreement.
A Plus Literacy LLC reserves the right to reschedule or cancel sessions due to illness, emergencies, holidays, or other circumstances, and will make reasonable efforts to provide advance notice.
5. Virtual Sessions and Client Responsibilities
For virtual sessions, families are responsible for providing a reliable internet connection, a working device with audio/video, and a quiet learning environment. A Plus Literacy LLC is not responsible for disruptions caused by technical issues outside our control.
Parents and guardians agree to:
Provide accurate information about the student's academic history, needs, and accommodations
Ensure the student attends sessions on time and is prepared to participate
Maintain timely, respectful communication
Make timely payments as outlined in the Tutoring Agreement
6. Educational Disclaimer and No Guarantee of Results
A Plus Literacy LLC provides educational tutoring only and does not provide medical, psychological, diagnostic, or special education services. We do not diagnose learning disabilities, ADHD, dyslexia, or similar conditions.
We do not guarantee specific academic outcomes, grade improvements, test scores, reading levels, or rates of progress. Results depend on factors including student effort, attendance, consistency, and circumstances outside our control.
7. Code of Conduct and Recording Policy
Students, parents, and guardians are expected to treat tutors and staff with respect and courtesy. A Plus Literacy LLC reserves the right to suspend or terminate services in cases of disrespectful, abusive, or inappropriate conduct.
Tutoring sessions may not be audio recorded, video recorded, photographed, or shared without prior written consent from A Plus Literacy LLC.
8. Location and Safety
For in-person sessions at public locations such as libraries, parents and guardians are responsible for drop-off, pick-up, and supervision before and after the scheduled session. A Plus Literacy LLC is not obligated to remain with a student beyond the scheduled session time, and repeated late pick-ups may affect continued enrollment.
9. Termination of Services
Either party may terminate services in accordance with the Tutoring Agreement. A Plus Literacy LLC reserves the right to terminate services at its discretion for reasons including, but not limited to, non-payment, repeated cancellations, or violation of these Terms.
10. Intellectual Property
All instructional materials, assessments, worksheets, progress reports, branding, and content provided by A Plus Literacy LLC are the property of A Plus Literacy LLC and may not be copied, distributed, reproduced, or used for commercial purposes without written permission.
11. Privacy and Third-Party Services
Our collection, use, and protection of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms. We may use third-party platforms for scheduling, payment processing, communications, and educational tools, and are not responsible for their policies or practices.
12. Use of Website
By using our website, you agree not to use the site for unlawful purposes, attempt unauthorized access to our systems, copy or distribute website content without permission, or submit false information through our forms.
13. Limitation of Liability and Indemnification
To the fullest extent permitted by law, A Plus Literacy LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability for any claim shall not exceed the amount paid by the client in the one (1) month immediately preceding the claim.
You agree to indemnify and hold harmless A Plus Literacy LLC, its owner, employees, and contractors from any claims, damages, or expenses arising from your use of our services or violation of these Terms.
14. Governing Law
These Terms shall be governed by the laws of the State of Arizona. Any disputes shall be resolved in the state or federal courts located in Maricopa County, Arizona.
15. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated Effective Date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
